THE LAW
EVERY HOME IN TEXAS THAT IS NOT
CONNECTED TO CITY SEWER MUST POSSESS AND MAINTAIN A LEGALLY
PERMITTED SEPTIC SYTEM. EXISTING SYSTEMS THAT WERE
INSTALLED BEFORE SEPTEMBER 1, 1989 MAY CONTINUE TO OPERATE WITHOUT
A PERMIT, AS LONG AS THE SYSTEM IS NOT
CREATING A NUISANCE, IT
HAS NOT BEEN ALTERED
AND IT IS NOT IN NEED OF REPAIR.
HOWEVER, ONCE YOUR SYSTEM
FAILS,YOU ARE REQUIRED TO OBTAIN A PERMIT FOR
CONSTRUCTION OF A NEW
ON-SITE SEWAGE FACILITY (OSSF),
WHICH MEETS STATE
REQUIREMENTS.
CHECK BEFORE YOU BUY YOUR
LAND:
a. MAKE SURE THAT THE LOT IS LARGE
ENOUGH
- AT LEAST 1 ACRE WITH A WATER
WELL OR
- 1/2 ACRE WITH CITY WATER
- NOTE THAT SMALL LOTS ARE ALLOWED TO HAVE NEW OSSFS PERMITTED, AS LONG AS
IT WAS LAST SUBDIVIDED BEFORE SEPTEMBER 1, 1989
b. CHECK THE SOIL
CONDITIONS
- HAVE A SITE EVALUATION
PERFORMED
- THIS WILL DETERMINE WHAT TYPE OSSF WILL WORK FOR YOUR
SITE
