Debt Claim Petition

Debt Claim - When a debt claim has been filed against you - Information Packet 

   A debt claim case is a lawsuit brought to recover a debt by an assignee of a claim, a debt collector
   or collection agency, a financial institution, or a person or entity primarily engaged in the
   business of lending money at interest. 

   The claim can be for no more than $10,000 for cases filed before September 1, 2020, and $20,000
   for cases filed on or after that date, excluding statutory interest and court costs but
   including attorney fees, if any Debt claim cases in justice court are governed by Rules 500-507
   and 508 of Part V of the Rules of Civil Procedure. To the extent of any conflict between Rule 508
   and the rest of Part V, Rule 508 applies.

   Once you click on this link, a box will appear that says "my Voting Districts." Enter the address you
   are trying to determine the precinct for and click the search button. A list will come up below
   the address. The first one should say "County Elected Representative." When you click the arrow next
   to it, it will show the precinct of that address.

Small Claim Information Packet

   A small claims case is a lawsuit brought for the recovery of money damages, civil penalties,
   personal property, or other relief allowed by law. The claim can be for no more than $10,000
   for cases filed before September 1, 2020, and $20,000 for cases filed on or after that date,
   excluding statutory interest and court costs but including attorney fees, if any
   Small Claims cases are governed by Rules 500-507 of Part V of the Rules of Civil Procedure.

Small Claims Petition

   This link will take you to a form for a small claims petition. Use this form to file your small
   claims petition. Be sure to fill the form out completely including your address, phone number
   and an email address if you are willing to accept correspondence through email.

Statement of Inability to Afford Payment of Court Costs

   Courts must not deny you access to justice simply because you cannot afford filing fees or 
   service fees. If you are unable to pay those fees, fill out a Statement of Inability to Afford Payment
   of Courts Costs form. You must swear to the information that you provide on this form and can
   face legal consequences if you do not fill it out to the best of your ability. Fill out the form
   completely and truthfully!
