The County Clerk serves as the official record keeper for the Official Public Records involving real property, records all documents for County Court, Commissioner's Court and County Probate/Civil Court.

EFFECTIVE JANUARY 1, 2024, the County Clerk's office will no longer charge the $1.00 courthouse security fee. Senate Bill No. 1612 repealed this fee under LGC Chapter 291.

The new fee for recording in the Official Public Records will be $25.00 for the first page and $4.00 for each additional page.

This affects the fees for OPR Recordings, DBA's, Cattle Brands, Marriage Licenses, Informal Marriage Licenses, and Notice of Trustee’s Sales.

The Clerk’s office has made a conscious effort to be on the lookout for documents that may involve deed or mortgage related fraud. For your protection, consider subscribing to our "FREE" Property Fraud Alert website for real-time monitoring and notification of any potential fraudulent activity. Your security does matter!

Unfortunately, it's all too easy for a criminal to record a fraudulent deed making it appear as if they now own your home.

Once they've done this, they can use your name as collateral on a mortgage or even attempt to sell your home to an unsuspecting buyer.

    NEW REQUIREMENT: CERTIFIED COPIES OF BIRTH AND DEATH CERTIFICATES: Effective September 1, 2015, all applications for certified copies of Birth and Death certificates which are mailed into the County Clerk's office must be signed in front of a notary public, per Health and Safety Code, Sec. 191.0031.

    Beginning July 1, 2019 attorneys MUST electronically file criminal documents in Caldwell County. (See Court of Criminal Appeals Order No. 16-003).

    Please read through the rules below, paying close attention to Part 5 regarding the filing of documents that contain sensitive date, if the data is not specifically required by statute or court rule.
