Office of County Clerk
The office of County Clerk has been in existence in Texas since 1836, superseding the escribano (secretary) of Spanish-Mexican rule. Article V, Section 20 of the Texas Constitution provides: There shall be elected for each county, by the qualified voters, a County Clerk, who shall hold his office for four years, who shall be Clerk of the County and Commissioners Courts and recorder of the county, whose duties, perquisites and fees of office shall be prescribed by the Legislature, and a vacancy in whose office shall be filled by the Commissioners Court, until the next general election…

The County Clerk:
• serves as Clerk for the county court, county courts at law, and the county;
• keeps records pertaining to the county courts, and real and personal property;
• records vital statistics, including birth and death certificates;
• issues marriage licenses;
• administers other licensing and recording requirements; and
• conducts countywide special and general elections and handles early voting.

ELECTIONS AND VOTER REGISTRATION
The Fannin County Clerk serves as the Voter Registrar for Fannin County and is responsible for registering all eligible voters, providing a list of qualified voters to all other county entities for their elections, and making reports to the Secretary of State. The County Clerk’s office conducts all countywide special and general elections and handles Early Voting for the countywide elections. The County Clerk’s office is responsible for maintenance of candidate/officeholder reports and appointments of campaign treasurer designations for county offices.

Fraud Alert - Fannin County, Texas
The threat of mortgage fraud and identity theft crimes continue to rise, and all too often victims of these types of fraudulent activities are unaware their homes or identity have been stolen. According to the FBI, property and mortgage fraud is among the fastest growing white-collar crimes in the United States. While Property Fraud Alert does not prevent fraud from happening; it provides an early warning system for property owners to take appropriate actions should they determine possible fraudulent activity has taken place.
Property Fraud Alert is an online subscription service offered free through the Fannin County Clerk’s Office to the public that allows them to have their name monitored in order to track possible fraudulent recordings that affects their property.
It's simple! Just enter your personal and/or business name and you will be notified by email or phone when a document is recorded with your name match.

Many Land Records are now available online—including current public records and records dating back to the Mid-1970’s. Records are being added to the database on an ongoing basis. Older records, including Historical Records dating back to the 1840’s, are available in the County Clerk’s Office.

CRIMINAL DEPARTMENT
The Criminal Department is responsible for the filing and upkeep of all misdemeanor criminal cases—such as DWIs, thefts by check, possession of marijuana, criminal trespass, and tampering with government records, etc. The criminal clerk also handles criminal searches, issues arrest warrants and subpoenas, and other miscellaneous duties. The Criminal Clerk receives and reports payment of fines and court costs; reports dispositions to the Office of Court Administration and to the Texas Department of Public Safety and acts as the Clerk for the County Court at Law.

PROBATE, GUARDIANSHIP, AND CIVIL DEPARTMENT
Probate and Guardianship Court cases deal with protecting the wishes, rights and obligations of persons regarding their property when individuals are unable to do so as a result of death, (probating will) or incapacitating illness, either physical or mental.
Mental Commitments relate to the involuntary commitment of an individual and requires the adherence to the temporary commitment procedures codified in the Texas Mental Health Code. Before the Mental Health Court, i.e., the Probate Court, can issue an Order of Protective Custody (OPC) to restrain an individual with mentally illness who presents a substantial risk of serious harm to him or herself or others, with proper paperwork and Court proceedings.
Civil courts hear cases regarding small claims, appeals from the justice of the peace courts, condemnations, and various other cases that do not involve criminal charges. (Note that divorces, custody, and other family cases are heard by the District Court.)
