What is a Texas Constable?

Texas constables, constitutionally authorized peace officers elected by precinct, have a mission to serve the courts, enforce laws, and maintain public safety, while also serving as officers of the Justice of the Peace Courts.

  • Serving the Court:
    Constables are the primary process servers for the Justice of the Peace Court diligently serving civil and criminal process.
  • Enforcing Laws:
    They enforce local, state, and federal laws with integrity and fairness, contributing to the safety of the community. 
  • Maintaining Public Safety:
    Constables perform patrol functions, conduct criminal investigations, and work to prevent crime and ensure a safe environment for residents.


How can you become a Texas Constable....

To become a constable in Texas, you must be a licensed Texas peace officer, which requires completing a state-certified law enforcement academy and passing the state peace officer licensing examination, and then run for election in the precinct you wish to serve.

Here's a more detailed breakdown:
 
1. Become a Licensed Texas Peace Officer:
  • Complete a Basic Peace Officer Course:
    Attend a state-licensed law enforcement academy and complete a 1260-hour Basic Peace Officer Course.
    Pass the State Peace Officer Licensing Examination:
    Successfully pass the state licensing exam administered by the Texas Commission on Law Enforcement Officer (TCOLE).
    Obtain a License:
    Once you meet the requirements, you'll receive a Texas Peace Officer license.

2. Run for Election as a Constable:
  • Residency Requirements: You must be a registered voter in the precinct for which you are running.
  • No Felony Conviction: You cannot have a felony conviction.
  • Must not have been convicted of a Class A Misdemeanor or above
  • Must not have been convicted of a Class B misdemeanor within the last 10 years
  • Active or Inactive Peace Officer LicenseYou must have an active or inactive peace officer license at the time of election
 
3. Additional Notes:
  • Age: Must be 21 years old
  • TCOLE: The Texas Commission on Law Enforcement Officer (TCOLE) is the agency responsible for licensing peace officers in Texas.
  • Education: You must have an associate's degree or higher, or be a active/retired peace officer.
  • Must attend in-service training, including 40 hours of training in any 24-month period and 24 hours of civil process training every 24 months.
  • Must complete Continuing Education for Constables (#3743) through LEMIT each 4-year training cycle thereafter.
  • Must complete an additional 8 hours of ALERRT training to meet the 16-hour legislative requirement.
  • Citizenship: Must be a U.S. Citizen
