About the District Clerk…

       As the District Clerk of Live Oak County, Sara serves as clerk of the court in all criminal and civil & family matters at the district level.  These cases include felony criminal proceedings, civil disputes involving personal injury, contracts, and property matters, as well as family law cases such as divorces, parent-child relationships, and Attorney General actions. 

       The District Clerk's Office (DCO) is the official custodian of all records, filings, and pleadings associated with cases filed in the district courts.  In this capacity, the office is responsible for maintaining the integrity and accessibility of court records while supporting the judicial process through the preparation and issuance of legal documents, which include citations, writs, subpoenas, warrants, and other court-related filings.

       Additionally, the DCO performs a wide range of administrative and clerical functions essential to the efficient operation of the district courts and serves as a vital resource for the judiciary, attorneys, and the public.

PLEASE BE ADVISED that the District Clerk's Office does not accept any email, fax, or mail-in filings, nor do we hold any sort of forms for filing into a case.  Instead:

*All filing fees are NON-REFUNDABLE; you are accountable for any errors in the petitions or subsequent actions.  In addition, the District Clerk's office is legally prohibited from offering guidance on form completion or providing instructions on post-filing procedures. 

Prior to filing any petition, the District Clerk strongly advises consulting a licensed attorney.

The Court Costs and Fees are for clerical services performed at the time the amounts are charged.  The District Clerk cannot refund any fees, regardless of the outcome of your lawsuit.

  • The Significance of Jury Service

    Jury service is an important civic duty, ranking second only to the right to vote. In accordance with the United States Constitution, jurors are selected randomly, without regard to race, gender, occupation, education, or economic status, to ensure a representative cross-section of the county's population. County court, as well as the Justice of the Peace courts of Live Oak County, also follow this practice, selecting jurors from throughout the county.

    The judgments delivered by a jury hold great importance. Whether the case is highly complex or involving significant sums or a collision loss, every juror must take their responsibility seriously to ensure a fair and just court decision. Responding to the summons for jury duty is a responsibility shared by all Live Oak County residents.

    Failure to Answer Summons and Penalties: A person who fails to comply with this summons is subject to a contempt action punishable by a fine not less than $100 nor more than $1,000 (Government Code, Section 62.0141). Additionally, a person shall be fined not less than $100 nor more than $500 if the person: (1) fails to attend court in obedience to this summons without reasonable excuse; or (2) files a false claim of exemption from jury service. (Government Code, Section 62.111. See also Code of Criminal Procedures, article 35.01)

    Jury Summons Process (Please Read Your Summons Carefully)  

    • IF YOU CHOOSE TO WAIT UNTIL THE DAY OF SERVICE TO POSTPONE OR BE EXCUSED FROM JURY SERVICE, ONLY THE JUDGE MAY EXCUSE/POSTPONE YOU FROM SERVICE.
    • The exemptions and disqualifications for petit jury service are stated on the summons. If any disqualification applies to you, you cannot serve. 
    • You must circle the disqualification and return the card to the District Clerk. If an exemption applies to you, you do not have to claim it, and you may choose to serve.
    • If you claim an exemption or disqualification, please do so immediately upon receipt of your summons. Please circle the appropriate number, then sign and date the summons card and return the whole card to the District Clerk’s Office.
    • You must report for jury service unless you: (1) claim exemption: (2) are disqualified; (3) or choose to postpone your service.
    • To Postpone your service, contact the District Clerk’s office at 361-449-2733 ext. 2 before your scheduled date of service. 
    • To claim a Medical Exemption, you will need to fill out the Affidavit for Exemption from Jury Duty for Physical or Mental Impairment.  The first page of the form must be completed by juror and signed before a notary. The second page is to be completed by juror's physician. The Affidavit must be returned to the District Clerks office to be presented to the Judge for consideration.
    • The DRESS CODE for District Court is as follows: Clothing befitting the dignity and solemnity of the court proceeding--NO shorts, sleeveless tops, t-shirts (undershirts), bare feet or rubber sandals (flip-flops) or caps/hats will be allowed in the court room.

     

    Grand Jury information

    If you receive a summons for Grand Jury duty and feel that you cannot serve, please contact the District Court Judge's office at 361-364-9310 for more information. The Judge is the only person who can excuse you from Grand Jury service prior to the summons date


    NOTICE: You may call our office at (361) 449-8060 the Friday before reporting for Jury Duty to inquire if your service is still needed. If Jury Duty is cancelled, no further action is required.

  • The following is a list of local agencies typically involved in the expunction process, as well as a couple of state agencies.  Any outside agency that has published your information concerning the charge/arrest will need to be researched by you and their address and email provided in your petition.  Please include the physical/ mailing and email address of each agency in your petition.  Duplicate agencies will not be notified.

    Note: The fee to issue an expunction petition/order is $25.00 per agency, which covers the certified mailing cost. If you include the agency's email address in the petition/order, then NO “issue expunction-certified mail” FEE is required.
